1. Allgemeine Hinweise und Informationspflichten

Wir haben diese Datenschutzerklärung (Fassung 03.12.2018-221081087) verfasst, um Ihnen gemäß der Vorgaben der Datenschutz-Grundverordnung (EU) 2016/679 und dem Datenschutzgesetz (DSG) zu erklären, welche Informationen wir sammeln, wie wir Daten verwenden und welche Entscheidungsmöglichkeiten Sie als Besucher dieser Webseite haben.

Leider liegt es in der Natur der Sache, dass diese Erklärungen sehr technisch klingen, wir haben uns bei der Erstellung jedoch bemüht die wichtigsten Dinge so einfach und klar wie möglich zu beschreiben.

Automatische Datenspeicherung

Wenn Sie heutzutage Webseiten besuchen, werden gewisse Informationen automatisch erstellt und gespeichert, so auch auf dieser Webseite.

Wenn Sie unsere Webseite so wie jetzt gerade besuchen, speichert unser Webserver (Computer auf dem diese Webseite gespeichert ist) automatisch Daten wie

  • die Adresse (URL) der aufgerufenen Webseite

  • Browser und Browserversion

  • das verwendete Betriebssystem

  • die Adresse (URL) der zuvor besuchten Seite (Referrer URL)

  • den Hostname und die IP-Adresse des Geräts von welchem aus zugegriffen wird

  • Datum und Uhrzeit

in Dateien (Webserver-Logfiles).

In der Regel werden Webserver-Logfiles zwei Wochen gespeichert und danach automatisch gelöscht. Wir geben diese Daten nicht weiter, können jedoch nicht ausschließen, dass diese Daten beim Vorliegen von rechtswidrigem Verhalten eingesehen werden.

Die Rechtsgrundlage besteht nach Artikel 6  Absatz 1 f DSGVO (Rechtmäßigkeit der Verarbeitung) darin, dass berechtigtes Interesse daran besteht, den fehlerfreien Betrieb dieser Webseite durch das Erfassen von Webserver-Logfiles zu ermöglichen.

Speicherung persönlicher Daten

Persönliche Daten, die Sie uns auf dieser Website elektronisch übermitteln, wie zum Beispiel Name, E-Mail-Adresse, Adresse oder andere persönlichen Angaben im Rahmen der Übermittlung eines Formulars oder Kommentaren im Blog sowie Fotos, werden von uns gemeinsam mit dem Zeitpunkt und der IP-Adresse nur zum jeweils angegebenen Zweck verwendet, sicher verwahrt und nicht an Dritte weitergegeben.

Wir nutzen Ihre persönlichen Daten somit nur für die Kommunikation mit jenen Besuchern, die Kontakt ausdrücklich wünschen und für die Abwicklung der auf dieser Webseite angebotenen Dienstleistungen und Produkte.   • Recht, nicht einer ausschließlich auf einer automatisierten Verarbeitung — einschließlich Profiling — beruhenden Entscheidung unterworfen zu werden (Artikel 22 DSGVO)

Wenn Sie glauben, dass die Verarbeitung Ihrer Daten gegen das Datenschutzrecht verstößt oder Ihre datenschutzrechtlichen Ansprüche sonst in einer Weise verletzt worden sind, können Sie sich bei der Aufsichtsbehörde beschweren, welche in Österreich die Datenschutzbehörde ist, deren Webseite Sie unter https://www.dsb.gv.at/ finden.

TLS-Verschlüsselung mit https

Wir verwenden https um Daten abhörsicher im Internet zu übertragen (Datenschutz durch Technikgestaltung Artikel 25 Absatz 1 DSGVO). Durch den Einsatz von TLS (Transport Layer Security), einem Verschlüsselungsprotokoll zur sicheren Datenübertragung im Internet können wir den Schutz vertraulicher Daten sicherstellen. Sie erkennen die Benutzung dieser Absicherung der Datenübertragung am kleinen Schloss Symbol links oben im Browser und der Verwendung des Schemas https (anstatt http) als Teil unserer Internetadresse.

Löschung der verarbeiteten Daten

Die von uns verarbeiteten Daten werden nach Maßgabe der Art. 17 und 18 DSGVO gelöscht oder in ihrer Verarbeitung eingeschränkt. Sofern nicht im Rahmen dieser Datenschutzerklärung ausdrücklich angegeben, werden die bei uns gespeicherten Daten gelöscht, sobald sie für ihre Zweckbestimmung nicht mehr erforderlich sind und der Löschung keine gesetzlichen Aufbewahrungspflichten entgegenstehen. Sofern die Daten nicht gelöscht werden, weil sie für andere und gesetzlich zulässige Zwecke erforderlich sind, wird deren Verarbeitung eingeschränkt. D.h. die Daten werden gesperrt und nicht für andere Zwecke verarbeitet. Das gilt z.B. für Daten, die aus handels- oder steuerrechtlichen Gründen aufbewahrt werden müssen.

Nach gesetzlichen Vorgaben in Österreich erfolgt die Aufbewahrung insbesondere für 7 Jahre gemäß § 132 Abs. 1 BAO (Buchhaltungsunterlagen, Belege/Rechnungen, Konten, Belege, Geschäftspapiere, Aufstellung der Einnahmen und Ausgaben, etc.), für 22 Jahre im Zusammenhang mit Grundstücken und für 10 Jahre bei Unterlagen im Zusammenhang mit elektronisch erbrachten Leistungen, Telekommunikations-, Rundfunk- und Fernsehleistungen, die an Nichtunternehmer in EU-Mitgliedstaaten erbracht werden und für die der Mini-One-Stop-Shop (MOSS) in Anspruch genommen wird.

2. Datenerfassung auf unserer Website

Serverlogin Dateien

Der Provider der Seiten erhebt und speichert automatisch Informationen in so genannten Server-Log-Dateien, die Ihr Browser automatisch an uns übermittelt. Dies sind:

Eine Zusammenführung dieser Daten mit anderen Datenquellen wird nicht vorgenommen.

Grundlage für die Datenverarbeitung ist Art. 6 Abs. 1 lit. b DSGVO, der die Verarbeitung von Daten zur Erfüllung eines Vertrags oder vorvertraglicher Maßnahmen gestattet.

Kontaktformular

Wenn Sie uns per Kontaktformular Anfragen zukommen lassen, werden Ihre Angaben aus dem Anfrageformular inklusive der von Ihnen dort angegebenen Kontaktdaten zwecks Bearbeitung der Anfrage und für den Fall von Anschlussfragen bei uns gespeichert. Diese Daten geben wir nicht ohne Ihre Einwilligung weiter.

Die Verarbeitung der in das Kontaktformular eingegebenen Daten erfolgt somit ausschließlich auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Sie können diese Einwilligung jederzeit widerrufen. Dazu reicht eine formlose Mitteilung per E-Mail an uns. Die Rechtmäßigkeit der bis zum Widerruf erfolgten Datenverarbeitungsvorgänge bleibt vom Widerruf unberührt.

Die von Ihnen im Kontaktformular eingegebenen Daten verbleiben bei uns, bis Sie uns zur Löschung auffordern, Ihre Einwilligung zur Speicherung widerrufen oder der Zweck für die Datenspeicherung entfällt (z.B. nach abgeschlossener Bearbeitung Ihrer Anfrage). Zwingende gesetzliche Bestimmungen – insbesondere Aufbewahrungsfristen – bleiben unberührt.

3. Soziale Medien

Wir binden auf unserer Webseite Elemente von Social Media Diensten ein um Bilder, Videos und Texte anzuzeigen. 4. Newsletter Datenschutzerklärung

Mit den nachfolgenden Hinweisen informieren wir Sie über die Inhalte unseres Newsletters sowie das Anmelde-, Versand- und das statistische Auswertungsverfahren sowie Ihre Widerspruchsrechte auf. Indem Sie unseren Newsletter abonnieren, erklären Sie sich mit dem Empfang und den beschriebenen Verfahren einverstanden.

Der Versand des Newsletters und die mit ihm verbundene Erfolgsmessung erfolgt auf Grundlage einer Einwilligung der Empfänger gem. Art. 6 Abs. 1 lit. a, Art. 7 DSGVO i.V.m § 107 Abs. 2 TKG bzw. auf Grundlage der gesetzlichen Erlaubnis gem. § 107 Abs. 2 u. 3 TKG.

Die Protokollierung des Anmeldeverfahrens erfolgt auf Grundlage unserer berechtigten Interessen gem. Art. 6 Abs. 1 lit. f DSGVO. Unser Interesse richtet sich auf den Einsatz eines nutzerfreundlichen sowie sicheren Newslettersystems, das sowohl unseren geschäftlichen Interessen dient, als auch den Erwartungen der Nutzer entspricht und uns ferner den Nachweis von Einwilligungen erlaubt.

Kündigung/Widerruf – Sie können den Empfang unseres Newsletters jederzeit kündigen, d.h. Ihre Einwilligungen widerrufen. Einen Link zur Kündigung des Newsletters finden Sie am Ende eines jeden Newsletters. Wir können die ausgetragenen E-Mailadressen bis zu drei Jahren auf Grundlage unserer berechtigten Interessen speichern bevor wir sie für Zwecke des Newsletterversandes löschen, um eine ehemals gegebene Einwilligung nachweisen zu können. Die Verarbeitung dieser Daten wird auf den Zweck einer möglichen Abwehr von Ansprüchen beschränkt. Um unseren Newsletter empfangen zu können, benötigen wir von Ihnen eine aktuelle E-Mail-Adresse. Mit der Anmeldung speichern wir Ihre IP-Adresse und das Datum der Anmeldung. Diese Daten werden von uns vertraulich behandelt.
